- Findings
- Alleged Victim (AV) is often oriented to person and often disoriented to time and place. Witness #1 (W1) is oriented to person and sometimes situation and wanders within the facility. W1 has a history of resident-to-resident altercations and aggressive behaviors towards residents and staff. On or about April 1, 2024, W1 experienced escalating behaviors over a three-hour period. Non-pharmacological and pharmacological interventions attempted by staff to de-escalate and calm W1 were unsuccessful. W1 approaches AV while AV is seated in a chair in the dining room, and AV seems to motion with h/h hands for W1 to leave them alone. W1 then walks past AV and appears to bump into AV, and AV attempts to strike W1 with h/h arm. AV pulls back h/h arm and appears to be in pain. W1 then turns around and smacks AV in the forehead, to which AV appears to have a painful reaction. The encounter lasts approximately 32-seconds and the only staff visible in the camera footage is a dietary staff member who does not intervene . Minutes before this incident, W1 had been involved in a resident-to-resident altercation with a different resident in the other dining room. Staff were not present in the dining room when AV and W1 got into an altercation, indicating that staff were not monitoring W1 despite h/h escalating behaviors and prior resident-to-resident altercation. The facility failed to provide a safe environment with adequate supervision and interventions to address W1’s escalating behaviors, which resulted in unreasonable discomfort to AV, which is violation of resident rights, is considered neglect of care and constitutes abuse.
