Findings: The Alleged Victim (AV) relies on the facility for care and has a history of behaviors to include wandering and exit seeking, requiring monitoring and redirection. Witness 1 (W1) relies on the facility for care and has a history of aggressive verbal and physical behaviors, requiring monitoring and redirection. AV and W1 have a recent history of a physical altercation. According to an investigation, on or about April 6, 2024, AV and W1 were in an unwitnessed physical altercation where W1 punched AV in the head rending AV unresponsive. AV was transported to the hospital and diagnosed with a brain bleed. The facility failed to provide a safe environment for AV which is a violation of resident rights, is considered neglect of care and constitutes abuse.
