Findings: Witness 1 (W1) is oriented to person, place, and situation and relies on the facility staff to ensure that h/h personal care, safety, and supervision requirements are met. Alleged Victim (AV) does not have the ability to speak or to consent to sexual contact. W1 has a history of initiating inappropriate sexual contact with other residents. On or about April 24, 2024 W1 approached AV in the dining room and kissed AV on the head. The facility has failed to implement interventions to mitigate risk of W1's inappropriate sexual behavior. The facility failed to provide a safe environment to AV by failing to provide adequate supervision to W1, which resulted in W1 kissing AV without consent on or about April 24. 2024, which resulted in loss of personal dignity to AV.
