Findings: The Alleged Victim (AV) and Witness 1 (W1) both rely on the facility for their care and have a history of physical altercations with each other that includes multiple injuries and AV requiring hospitalization for a brain bleed. There are multiple interventions that were in place to mitigate W1’s aggressive behaviors, but facility staff didn’t always follow them due to being busy. According to an investigation, AV and W1 got into an altercation on May 3, 2024, resulting in a split lip for AV. On May 5, 2024, AV went into W1 room resulting in another altercation where W1 punched AV in the back of the head and pinched AVs nose. The facility failed to follow and/or implement effective interventions for W1 and provide a safe environment for AV, causing repeated unreasonable discomfort, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
