Findings
Alleged Victim (AV) and Witness 1 (W1) have a history of resident-to-resident altercations. AV has current interventions in place including, going on a walk, offer AV coffee, sitting AV in the dining room away from others that AV has had an altercation with, redirecting AV, encourage AV to attend activities, and a key to AV's room to prevent others from going into AV's room. W1 has current interventions in place including, giving W1 tasks to complete to keep W1 busy, offer encouragement to W1, redirect W1 if W1 is going towards other residents, offer to take W1 on walks outside, offer coffee, and keep W1 as occupied as possible. Other interventions include if staff see W1 getting mad at another resident, they are to redirect W1 down to W1's room, and if W1 is getting close to other residents' faces to redirect and ask for assistance with an activity. On or about May 19, 2024, AV was sitting at the table in the dining room by the medication room. W1 walked up towards AV, W1 places W1's hand on AV's back, AV then grabbed W1's arm, which then W1 grabbed AV's arm. AV then swatted away W1's arm and as AV and W1 release their arms from each other, AV has a skin laceration on AV's forearm. The Facility failed to provide a safe environment for AV, prevent the actions off W1 in spite of W1's known history, resulting in W1 getting into an altercation with AV, which caused AV to experience a skin laceration to AV's arm. W1's interventions were not being followed with the altercation not being witnessed while AV and W1 were in a common area together unsupervised, which is a violation of resident rights, is neglect of care and constitutes abuse.
