- Findings
- Alleged Victim (AV) and Witness 1 (W1) have a history of resident-to-resident altercations. W1 has behavior interventions documented on W1's service plan including redirecting, offering coffee, going on walks, designating projects, reminding W1 that staff are there to help when W1 is ordering other residents around and one-on-one visits with staff. AV does not have any listed behavior interventions documented on AV's service Plan or interim service plans until after the altercation with W1 on May 23, 2024. AV and W1 were in a separate resident-to-resident altercation on May 18, 2024, where AV attempted to sit with W1 and other residents, W1 became agitated leading to W1 attempting to remove AV's chair causing the altercation resulting in AV falling on the floor. On or about May 23, 2024, AV sat next to W1 in the hub area. W1 was agitated. AV had sat down next to W1 and W1 gestured for AV to leave. W1 stood up and pushed the chair W1 was sitting in out of the way and hit AV in the back. W1 then tried to push AV out of the chair. Staff intervened, and redirected AV and W1. The Facility failed to provide a safe environment for AV, prevent the actions off W1 in spite of W1's known history, resulting in W1 getting into an altercation with AV. W1's interventions were not being followed and AV had no additional interventions in place after AV and W1's altercation on May 18, 2024. W1 is to be monitored closely in common areas and staff are to redirect if they see any other residents coming towards W1. AV and W1 were not being observed at the time of the altercation, which is a violation of resident rights, is neglect of care and constitutes abuse.
