Findings: The Alleged Victim (AV) is known to wander and lay down on other residents beds when tired. On or about May 30, 2024, staff found the AV in Witness #1's (W1) bed. AV was not wearing any clothes, however W1 still had his/her clothes on. On or about May 31, 2024, staff found AV naked on W1's bed and W1 was also naked. W1 was holding AV's legs up, attempting to engage in a sexual act. AV repeatedly stated he/she was scared after the incident. The facility failed to put a safety plan in place after the incident for AV or W1 and failed to send AV out for a Sexual assault exam or any medical attention until 5 days after the incident. The facilities failure to put interventions in place for known sexualized behaviors by W1 placed AV at risk of serious harm, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
