Findings: Alleged Victim (AV) is a resident of and under the care of the facility. AV is service planned as having a history of trying to harm others and attempting to go after them without stopping. AV has been involved in several resident-to-resident altercations in which AV used extreme violence towards other residents. On or about April 25, 2024, AV charged at another resident, hit the other resident's head over and over again, and then throw the other resident into the wall headfirst. The other resident was taken to the hospital for treatment. Based on facility documentation and interviews, AV's service plan does not address AV's explosive behaviors, causing harm to AV and other residents of the facility. The facility's failure to implement interventions and appropriately care plan related to AV's known behaviors and recent increase of altercations, resulted in AV causing unreasonable discomfort to others, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
