Findings: The Alleged Victim (AV) and Witness 1 (W1) both rely on the facility for their care. W1 has a history of aggressive behaviors and physical altercations, and is care planned for staff to provide 1:1 care when W1 is agitated. According to an investigation, on or about July 9, 2024, W1 was agitated and went into AV’s room and hit AV in the shoulder, causing AV distress. The facility failed to follow W1’s care plan and keep AV safe, which is a violation of resident rights, is considered neglect of care and constitutes abuse. The allegation that Alleged Perpetrator 2 (AP2) failed to follow the care plan regarding medication refusals was investigated and determined to be not substantiated.
