Findings: Both the Alleged Victim (AV) and Witness 1 (W1) rely on the facility for care. W1 has a history of aggressive behaviors resulting in physical altercations that have occurred in the hallway and dining room, and care staff were educated to be aware of other residents and their entrance into the dining room when W1 is around. On or about July 11, 2024, W1 was walking to the dining room at meal time and approached the entrance to the dining room at the same time as AV. W1 yelled loudly at AV and then W1 hit AV with their walker, causing AV unreasonable discomfort. Facility staff observed the inception of the altercation, but were unable to stop it from occurring due to being busy with other tasks. The facility failed to provide a safe environment for AV, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
