Findings: Both the Alleged Victim (AV) and Witness 1 (W1) rely on the facility for care. W1 has a history of aggressive behaviors resulting in physical altercations that have occurred in the hallway and dining room, and care staff were educated to be aware of other residents and their entrance into the dining room when W1 is around. On or about July 11, 2024, W1 was walking to the dining room at mealtime and approached the entrance to the dining room at the same time as another resident and got into a physical altercation. When staff was redirecting the other resident away from the area, W1 then turned to AV and hit AV in the face and chest, causing AV unreasonable discomfort. The facility failed to provide a safe environment for AV, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
