Findings: The Alleged Victim (AV) and Witness #1 (W1) have a history of altercations and both have interventions in place to reduce altercations. On or about July 30, 2024, AV and W1 engaged in an altercation where the two were squeezing and shaking each other. AV was on one to one care at the time of the altercation, however, AV's one to one staff was not near AV and was assisting another staff within line of sight. W1 received scratches during the altercation. The facility failed to provide a safe environment for W1 by not following AV's service plan. The facility's failure is a violation of resident rights, is considered neglect of care and constitutes abuse.
