- Findings
- Witness 1 (W1) has a history of resident-to-resident altercations with other residents. Alleged Victim (AV) and W1 have a history of resident-to-resident altercations with each other. W1 is known to wander the neighborhood. AV does not want anyone to come into AV’s room nor touch AV's belongings. AV wants AV’s door to remain locked to keep resident’s out of AV’s room. On or August 15, 2024, W1 was able to open AV’s door and walk into AV’s room. AV told W1 to get out. W1 walked over to AV and W1 slapped AV in the face. The lock on AV's door was malfunctioning when you jiggle the handle, the door would come unlocked. AV does not feel safe and feels AV is going to have to use physical force to protect AV's self and room. The facility failed to provide a safe environment and implement appropriate interventions to mitigate the risk of serious harm to AV and protect AV from W1 entering Av's room. The facility failed to keep AV door lock in good working condition, which resulted in the lock not working and allowing W1 to come into AV room and hit AV in the face, which is a violation of resident rights, is neglect of care and constitutes abuse.
