Findings: The Alleged Victim (AV) relies on the facility to ensure their right and dignity. The AV is noted to be severely challenged cognitively. Witness 1 (W1) was noted to have sexually inappropriate behavior, to make sexual advances towards other residents, and had multiple reports of sexual assault. According to an investigation, on or about September 9, 2024, the AV was observed to be pushed out of W1's room. Both the AV and W1 had their briefs down. W1 had feces in their groin area. This resulted in significant emotional harm, unreasonable discomfort, and serious loss of personal dignity for the AV. The Alleged Perpetrators 3, 4, 5 and 6 were aware of the situation and took no action to ensure the safety, rights, and dignity of the AV. AP3, 4, 5, and 6’s actions are a violation of resident rights, considered neglect, and constitutes abuse. The facility failed to appropriately provide care and services for the AV to maintain dignity and safety, which is a violation of resident’s rights, is neglect of care and constitutes abuse.
