Findings: Alleged Victim (AV) was scheduled for surgery on or about September 4, 2024, and had doctor's orders to not eat after midnight before the surgery. Witness 6 (W6) was given the doctor's orders regarding AV's fasting for surgery. When a resident has doctor's orders or change of condition, a temporary care plan would be created and put in a book for all staff to observe, but this was not done. AV was reported as having breakfast that morning before going in for surgery. AV was at serious risk of aspiration during surgery by not following doctor's orders to fast before surgery. The facility failed to properly plan care and provided interventions appropriate to keep AV from eating prior to surgery, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
