Findings: The Alleged Victim (AV) relies on the facility for care, and is care planned for transfer assistance. On or about September 23, 2024, Alleged Perpetrator 2 (AP2) assisted AV with a transfer to bed. Not long after AP2 and another care staff were providing incontinence care to AV and AV was calling out in pain. AV was taken to the hospital by ambulance and diagnosed with a broken femur. According to an investigation, AV was care planned for a one person assist with transfers, but documentation also showed AV was a 2 person transfer. The allegation that AP2 neglected AV was investigated and was inconclusive, as the care plan was confusing and contradictory. The facility failed to provide services, to include properly care planning and/or implementing interventions to mitigate AV’s declining health and to ensure resident safety, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
