Findings: Both the Alleged Victim (AV) and Witness 1 (W1) rely on the facility for care and have a history of conflict and physical altercations with each other in their shared room. On or about September 30, 2024 and again on October 2, 2024, AV and W1 were in physical altercations, resulting in AV getting hit in the head with a cane and their fingers squished in the cane. The facility failed to implement effective interventions to address both AVs and W1s interpersonal conflict and behaviors, and provide a safe environment for AV, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
