Findings: Both the Alleged Victim (AV) and Witness 1 (W1) rely on the facility for care and have a history of conflict and physical altercations with each other in their shared room. On or about October 2, 2024, W1 was found on top of AV, with W1's arm pressing down on AV's throat and restricting AV's breathing resulting in AV experiencing shortness of breath and wheezing. The facility failed to implement effective interventions to address both AVs and W1s interpersonal conflict and behaviors, and provide a safe environment for AV, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
