- Findings
- Alleged Victim (AV) is Service Planned for wandering and is known to take objects from shared facility community spaces and AV interventions include; bringing another object to AV, asking AV to complete another task and or redirecting AV. On or about November 05, 2024, Per Investigators Video Footage of Incident Observations; AV was walking around the facility with the facility vacuum and AV walked past the staff desk and grabbed a jacket that didn’t belong to AV. Alleged Perpetrator 2 (AP2) walked up to AV and snatched the vacuum and jacket away from AV. AP2 then bends down to get the vacuum cord and in this process AP2 seems to bump into AV with AP2’s bottom. AV with an open hand slaps AP2 on AP2’s lower back. AP2 stands up and pushes AV back by placing AP2’s left hand on AV’s stomach and AP2 pushes AV against the wall. AV stretches AV’s right hand with a closed fist and hits AP2 in the throat or just below AP2’s throat. AP2 uses AP2’s left hand and grabs AV’s right wrist and then AV walks away. The facility failed to provide a safe environment, oversight for the health and safety of AV. According to an investigation, AV experienced Unreasonable discomfort. The failure is a violation of Oregon Administrative Rules. The allegation that AP2 Physically Abused AV was investigated and determined AP2’s actions are a violation of resident rights, are considered neglect of care and constitutes physical abuse.
