- Findings
- Alleged Victim (AV) lives at Respondent’s secured/locked facility. AV has history of elopement and seeking exit. AV is oriented to self, time, place and people. AV is able and capable of memorizing the codes on access keypad to enter and exit the secured facility. AV’s service plan reflects that AV is at risk of elopement and knows the codes in and out of the facility. Facility staff are to monitor AV; facility staff is to allow AV outside in the secure courtyard area. Facility staff is to frequently check up on AV. However, facility staff failed to develop sufficient interventions to change codes on access keypad, and failed to follow the service plan to monitor and complete frequent checks on AV. On or about November 15, 2024, witness 3 (W3) an off-duty staff, spotted AV wandering in the community. AV knew the code to the access keypad in the courtyard and was able to exit the facility through a secured courtyard gate. Respondent failed to provide a safe environment, develop and implement suitable interventions, and follow AV's service plan. This constitutes abuse by neglect as defined by OAR 411-020-0002(1)(b)(A)(i).
