- Findings
- The Alleged Victim (AV) relied on the facility for care, was independent with most tasks and their care plan indicated AV to use their call pendant to request help when necessary. Between May 15, 2024, and December 5, 2024, AV had approximately eight (8) falls, some resulting in injury to include elbow, back, and head. According to an investigation, the facility did not implement progressive interventions to address AV's repeated falls and while it was stressed to AV to push their call light for assistance, AV's call light was not always answered timely. During this same timeframe AV's call button broke and AV was given a replacement button. The replacement button went missing, and it was stated that the Alleged Perpetrator 2 (AP2) took it out of AV's room. While the facility acknowledges the call button went missing, the allegation that AP2 took AV's call light from them, leaving them unable to call for help was investigated and found to be inconclusive. The facility failed to provide appropriate services, to include proper care planning and/or the implementation of effective interventions and resident monitoring, resulting in repeated falls and unreasonable discomfort, and placed AV at repeated risk of serious harm, which is a violation of resident rights, is considered neglect of care and constitutes abuse as defined by OAR 411-020-0002(1)(b)(A)(i) and (ii).
