Findings: The Alleged Victim (AV) and Witness 1 (W1) rely on the facility for his/her care. AV has a history of resident-to-resident altercations. AV and W1's charting notes included instructions for staff to have food and drinks in front of W1 at all times during meals and remain within view of AV to ensure safety. These instructions were not provided to staff in resident service plans or temporary service plans. According to an investigation, on or about January 29, 2025, AV tried to take a glass of milk from W1. When W1 removed the milk from AV's reach, AV tapped W1 on the head with a fist and W1 responded by pulling on AV's wrists and pulling AV onto W1's lap, resulting in AV screaming and becoming upset. The facility failed to timely address AV and W1's behaviors, which is a violation of resident’s rights, is neglect of care and constitutes abuse.
