- Findings
- Alleged Victim (AV) and Witness 1 (W1) are residents of the facility and the facility is responsible to provide safety to AV and W1. AV has a mood disorder and cognitive decline. W1 has a mood disorder, cognitive decline, and memory decline. AV has requested to have apartment door left open during waking hours. W1 has a history of hitting, wandering, exit seeking and behaviors after relative visits. On or about January 6, 2025, AV and W1 had a physical altercation that resulted in AV getting hit twice. On or about January 29, 20225, W1 attempted to attack AV, and accused AV of stealing "stuff" from W1. On February 13, 2025, AV and W1 had a resident-to-resident verbal altercation. After each incident the intervention put in place was to monitor and redirect W1. On or about February 21, 2025, W1 entered AV's room looking for a relative who had been visiting an hour earlier. AV responded verbally, W1 got upset and struck AV on the left side of AV's face. AV's glasses were knocked off and AV’s mouth started bleeding from the strike. AV and W1 continued to be verbally aggressive until staff intervened. The facility failed to implement adequate, person centered interventions, which led to AV and W1's resident-to-resident altercation resulting in AV being struck by W1 and causing AV's mouth to bleed.
