Findings: The Alleged Victim (AV) relies on the facility for his/her care. Witness 1 (W1) has a history of aggressive behavior and resident-to-resident altercations. According to an investigation, on or about April 4, 2025, W1 and AV were in a verbal altercation. A care staff in the room left to get assistance from other staff and W1 struck AV, resulting in AV flipping to the side in their wheelchair and obtaining a skin tear and bleeding nose. At the time of the incident, W1's service plan identified a high risk of altercations with roommates but did not provide enhanced interventions for staff to follow when behaviors occurred. The facility failed to properly address resident behaviors, which is a violation of resident’s rights, is neglect of care and constitutes abuse.
