Findings: The Alleged Victim (AV) relies on the facility for his/her care. Witness 1 (W1) has a history of aggressive behaviors resulting in physical altercations with other residents and has a documented intervention for staff to keep an eye on W1 when they leave their apartment. According to an investigation, on or about April 6, 2025, staff were not around when W1 got into a physical altercation with the AV in a common area of the facility, resulting in the AV receiving a contusion to their left hand and bruising to their right cheek. The facility failed to implement interventions to address W1 aggressive behaviors and provide a safe environment for AV, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
