- Findings
- The Alleged Victim (AV) resides in the Respondent’s facility and relies on facility staff for assistance with daily care needs and medication administration. AV has a metabolic disorder requiring twice-daily monitoring of metabolic markers. According to AV’s service plan, AV is independent with transfers, ambulates with a walker, has had one fall in the past six months, and is independent with communication. AV moved into the facility on or about April 6, 2025. By April 10, 2025, AV was barely able to move, and by April 14, 2025, AV was unable to get out of bed. AV was transported to the emergency room on April 14, 2025, due to weakness and elevated blood markers. On April 15, 2025, AV sustained three unwitnessed falls. The facility did not develop adequate interventions to address AV’s increasing risk. On or about April 16, 2025, AV was ambulating when AV experienced another unwitnessed fall, resulting in a closed head injury. AV was transported to the emergency room and was subsequently admitted with sepsis and generalized weakness that had worsened since April 14, 2025. The Respondent failed to develop and implement appropriate interventions to address AV’s care needs and changing condition. This constitutes abuse by neglect as defined in OAR 411-020-0002(1)(b)(A)(i).
