Findings: The Alleged Victim (AV) relies on the facility for his/her care. Witness 1 (W1) has a history of resident-to-resident altercations. According to an investigation, on or about January 12, 2025, W1 slapped AV across the mouth. At the time of the incident, W1's service plan did not provide specific interventions for staff to follow when behaviors occurred. The facility failed to properly address resident behaviors, which is a violation of resident’s rights, is neglect of care and constitutes abuse.
