Findings: The Alleged Victim (AV) and Witness 1 (W1) are dependent on the facility to meet his/her safety needs. W1 has a history of resident-to-resident altercations and being intrusive with other residents. According to an investigation, on or about May 18, 2025, AV and W1 were seated next to each other in the dining room when W1 tried to take AV's walker and struck AV on the shoulder and on the arm. W1's service plan did not include interventions for W1's intrusive or aggressive behaviors with other residents at the time of the incident. The facility failed to properly plan care to address resident behaviors and provide a safe environment for AV which is a violation of resident rights, is neglect of care which constitutes abuse.
