- Findings
- Alleged Victim (AV) and Witness 1 (W1) are residents of the facility and rely on staff to meet all care needs. AV and W1 have a history of altercations on or about June 27, 2025, and July 08, 2025, resulting in injury to AV. An intervention was put in place on June 27, 2025, if staff observe AV and W1 in the same area staff are to redirect AV and W1 to another location and offer a snack. An intervention was put in place on July14, 2025 stating each shift during waking hours staff will provide one-on-one care for AV and W1. On July 16, 2025, AV and W1 had an altercation in the dining room. W1 patted AV on the side to get AV to notice W1, AV hit W1 in the back, causing W1 to turn around and hit AV in the face. The facility failed to follow the care plan for one-on-one intervention and provide clear written description to staff on who shall provide the services and what, when, how, and how often the services shall be provided. The failure is a violation of resident’s rights is neglect of care and constitutes abuse.
