- Findings
- On or about July 22, 2025, Witness 1 (W1) physically struck the Alleged Victim (AV) while AV was attempting to pass by W1 in their shared or adjacent living space. Based on facility documentation and staff interviews, W1 and AV have a documented history of prior altercations. In response to this history, the facility implemented an intervention intended to mitigate conflict by attempting to keep the doorway clear of wheelchairs and residents to ensure safe and unobstructed passage for both AV and W1. Despite this intervention, the incident occurred, and the Oregon Department of Human Services (ODHS) Adult Protective Services (APS) investigation #00415768 determined that staff failed to adequately supervise W1 at the time of the incident. This lapse in supervision allowed W1 to strike AV, placing AV at risk of harm which is a violation of resident rights, is considered neglect of care, which constitutes abuse.
