- Findings
- Alleged Victim (AV) and Witness 1 (W1) are residents of AP1 and rely on AP1 staff to ensure basic care, safety, and supervision requirements are met. W1 has a history of resident-on-resident altercations. There is no history of resident-to-resident altercations between W1 and AV. It is known that W1 can become agitated easily, and It is not uncommon for W1 to hit people with W1's walker. Interventions outlined in W1's service plan include; AP1 staff are to provide frequent checks on W1 to know W1’s location, following meals AP1 staff should offer to escort W1 to W1’s room, or another common area where W1 is comfortable to rest. On or about August 9, 2025, W1 was sitting in the dining room when W1 saw AV get up and walk out of the dining room to AV’s apartment . W1 followed AV down the hallway, screaming “I’m going to get you!” W1 got in AV’s face continuing to scream at AV and AV turned to try to get away, W1 lifted up the front legs of W1’s walker and slammed it against AV’s legs. The facility failure to provide adequate supervision, escort W1 to W1 room after meals and provide a safe environment for AV, resulted in a resident-on resident altercation, placing AV at risk of harm, which is a violation of resident rights, is considered neglect of care and constitutes abuse.
