Findings: On or about August 21, 2025, the facility did not have a medication technician scheduled to work. Staff were called in who don't normally pass medications and Alleged Perpetrator #2 (AP2), who was still in training for passing medications. The Alleged Victim (AV) receives pain medication that is to be dispensed at 8:00 am. The hospice nurse called the facility and advised to not change AV's brief until his/her pain medication was given. On this day, due to not having staff scheduled, AV did not receive his/her pain medication timely, nor did AV get his/her brief changed timely, causing unreasonable discomfort. The Allegation against AP2 is not substantiated. Respondent failed to ensure staff were scheduled to pass medications, causing unreasonable discomfort to the resident. This constitutes abuse by neglect, as outlined in OAR 411-020-0002(1)(b)(A)(i).
