Findings: The Alleged Victim (AV) and Witness 1 (W1) are memory care residents residing in AP1 and rely on the facility for assistance with daily living and overall safety. Witness 1 (W1) has a documented history of exhibiting verbally and physically aggressive behaviors towards AP1 residents and staff. On or about August 27, 2025, another resident jiggled the handle of W1’s apartment door before walking away. W1 opened the door as AV was walking nearby. W1 struck AV on the side of the head, yelled, and pushed AV’s walker into AV. Interventions in place at the time of the incident were not effective to keep altercations from happening between W1, and AV. The facility failure to adjust and implement person centered interventions for W1 resulted in a verbal and physical resident-to-resident altercation with AV, placing AV at serious risk of harm, which is violation of resident rights, is considered neglect of care and constitutes abuse.
