Findings: Alleged Victim (AV) is care planned to use a wheelchair. Witness 1 (W1) will get very upset at times if other residents are having behaviors and will get frustrated with the residents. On or about October 17, 2025, W1 got physical with residents and ended up putting his/her arms arounds AV neck. Respondent failed to care plan appropriately resulting in AV being physically assaulted by W1, which lead to ensure the safety of AV. This constitutes abuse by neglect, as outlined in OAR 411-020-0002(1)(b)(A)(i).
