- Findings
- Alleged Victim (AV) resides in the Respondent’s facility and relies on facility staff to provide the care and services necessary to ensure AV’s health and safety. AV has a documented history of poor circulation in the lower extremities, resulting in bacterial skin infections, sores on the feet, and previous hospitalizations. On October 15, 2025, AV was discharged from the hospital to Respondent's facility after treatment for a bacterial skin infection affecting both lower legs. The hospital discharge instructions directed the facility to perform weekly skin checks for AV. Facility staff did not conduct any skin checks from AV’s move-in on October 15, 2025, until the first check on October 27, 2025. On or about October 30, 2025, AV was transported to the hospital and diagnosed with venous dysfunction causing discomfort, skin discoloration. At that time, AV exhibited redness to both lower legs, thickened and scaly skin, swelling from fluid accumulation, a line of dark scabs and black tissue on the left lower leg with scattered areas on the right shin, and a black tissue patch on the top of the left foot. The Respondent failed to implement and provide the basic care and services required to meet AV’s needs. This failure constitutes abuse by neglect.
