Findings: The Alleged Victim (AV) uses oxygen and has a history of smoking in their room. The AV's smoking evaluation indicated they were unsafe to smoke independently and their cigarettes and lighter were to be stored in the facility medication room. According to an investigation, on or about November 17, 2025, the AV lit a cigarette while wearing oxygen in their room. The AV caught fire, sustained burns to the face and body, and was sent to the emergency department for treatment. The facility failed to secure the AV's lighter and cigarettes which created an unsafe environment, which is a violation of resident’s rights, is neglect of care, and constitutes abuse.
