- Findings
- The Alleged Victim (AV) is a memory care resident residing in AP1 and depends on the AP1 staff for assistance with daily living and overall safety. According to AV’s service plan, dated on or about September 28, 2025, AV has a history of falls, poor gait, generalized weakness, decreased mobility, and uses a walker. AV wears briefs and requires AP1 staff to provide reminders, cues, and stand-by assistance for toileting. Per Witness 1 (W1), packages of briefs should not be stored or stacked on the shelf. On or about November 19, 2025, AV falls in the bathroom while reaching for a package of briefs placed high on the shelf. As a result, AV sustains fractures to the left hip and left arm. The facility failure to provide a safe environment by storing briefs in an unsafe location and not following AV’s service plan by ensuring stand-by assistance in the bathroom results in serious injury to AV, which is violation of resident rights, is considered neglect of care and constitutes abuse.
