- Findings
- Alleged Victim (AV) is care planned to receive assistance from staff with self-administration of all medications and treatments. Staff are to re-order all medications in a timely manner, to ensure that medication is received as ordered by the provider. AV returned from the hospital on or about December 4, 2025, for cough and generalized weakness. AV was to take [antibiotic medication] for four (4) days starting December 5, 2025. AV did not receive prescribed [antibiotic medication] from December 5, 2025 – December 7, 2025 . Alleged Perpetrator 2 (AP2) put the physician order in "medication queue" in Medication Administration Record (MAR) system on December 4, 2025, and faxed order to AV's pharmacy. The facility stopped doing the "medication queue " in March 2025 due to residents not receiving medication on time. AP2 was aware/trained that the "medication queue" process was ended in March 2025; AP2 forgot that the "medication queue" process was changed when processing the new medication order. On or about December 8, 2025, Witness 4 (W4) noticed that AV’s [antibiotic medication] had not yet been administered and followed up with medical provider. AP2 failed to administer ordered medication, which is neglect of care and constitutes abuse. Respondent failed to administer order medication, to ensure the safety of AV. This constitutes abuse by neglect, as outlined in OAR 411-020-0002(1)(b)(A)(i).
