Findings: Witness 1 (W1) has a history of altercations with Alleged Victim (AV) and other residents. On or about December 16, 2025, Staff heard yelling and when they went to investigate in the hallway, they saw AV on AV's back and W1 was hovering over AV and AV was grabbing AV's arm. As a result of the altercation, AV sustained a skin tear to his/her elbow. Respondent failed to provide a safe environment to AV, and to ensure the safety of AV. This constitutes abuse by neglect, as outlined in OAR 411-020-0002(1)(b)(A)(i).
