Findings: The Alleged Victim (AV) relies on the facility for their care. AV is a high fall risk as AV has a history of falls and an unsteady gait. According to an investigation, AV eloped, walking approximately 0.6 miles from the facility along a 4-lane highway serving as a main arterial street of the city: in addition to highway traffic. AV had to navigate a median strip that separates the two directions of traffic. According to witnesses, AV almost fell into an open hole at a construction site before crossing the highway to a nearby business. When AV was located, AV was crying and reporting that AV’s feet were hurting. Video footage did not capture AV leaving or how AV exited the facility due to the camera malfunctioning. The facility failed to provide a safe physical environment, which is a violation is neglect of care and constitutes abuse as defined in OAR 411-020-0002(1)(b)(A)(i) and (ii).
