Findings: On or about January 28, 2026, the Alleged Victim (AV) walked into Witness #1's (W1) room. W1 pushed AV out of the room causing AV to fall onto his/her bottom. W1 is territorial of his/her room, keeps his/her door open at all times and gets upset by other residents walking to close or into his/her room. W1 has had multiple altercations due to others being near W1's room or door. Interventions in place to keep residents safe aren't effective, such as keeping residents away from W1's door, as staff are not able to be at W1's door at all times. Respondent failed to ensure the safety of residents. This constitutes abuse by neglect, as outlined in OAR 411-020-0002(1)(b)(A)(ii).
