Findings: The Alleged Victim (AV) and Witness #1 (W1) have a history of altercations. On or about February 5, 2026, W1 and AV engaged in an altercation where W1 hit AV during snack time. W1 had been showing signs of agitation that day and staff are to monitor W1 when he/she is agitated and redirect from AV. W1 was redirected after the altercation, not prior. Respondent failed to ensure staff intervened to reduce the risk of altercations with residents, placing residents at risk for harm. This constitutes abuse by neglect, as outlined in OAR 411-020-0002(1)(b)(A)(ii).
