Findings: The Alleged Victim (AV) relies on the facility for his/her care. AV and Witness 1 (W1) have a history of resident-to-resident altercations and W1 made threats towards AV on multiple occasions between January 13, 2026, and February 21, 2026. According to an investigation, on or about February 21, 2026, W1 approached AV, punched, slapped and shook AV, resulting in AV falling to the ground and hitting AV's head against a chair. As a result of the fall and related injuries, AV was sent to the emergency department. At the time of the incident, W1's service plan identified a need for staff to assist with behavior management and included interventions of redirecting W1 to preferred activities. There were no specific interventions identified to address the threats W1 made towards AV in the days and weeks leading up to the incident on 2/21/26. The facility failed to properly care plan, which is a violation of resident’s rights, is neglect of care and constitutes abuse.
