- Findings
- Alleged Victim (AV) and Witness 1 (W1) reside in the Respondent’s facility and rely on facility staff to ensure that their basic care, safety, and supervision needs are met. AV and W1 have a history of resident-to-resident altercations, and W1 is known to wander throughout the facility and enter other residents’ rooms. AV does not tolerate other residents entering AV’s personal space. AV’s service plan indicates facility staff to keep AV’s apartment door locked at all times. The facility failed to follow with AV’s service plan and did not take appropriate measures to mitigate risk to AV and other residents. On or about March 6, 2026, W1 entered AV’s room. Facility staff heard yelling, responded, and found W1 on top of AV, striking AV in the face and head while AV attempted to kick W1. The physical altercation resulted in AV sustaining a bloody nose and a cut to the ear. EMS was contacted to assess AV.The Respondent failed to follow AV’s service plan and did not provide a safe environment. This constitutes abuse by neglect as defined under OAR 411-020-0002(1)(A)(i).
