- Findings
- Alleged Victim (AV) resides in the Respondent’s facility and relies on facility staff to ensure that AV’s basic care, safety, and supervision needs are met. AV has poor recent memory, requires assistance with complex decision-making, and has a history of falls, including approximately five falls between September 2025 and December 2025, and approximately three falls in January 2026 in which AV fell in AV’s bathroom or shower. AV’s service plan indicates, AV is independent with ambulation using a cane. Fall interventions include posting signs in AV’s room to call for assistance; use of an assistive device to retrieve items from the floor; encouraging AV to sit in a chair when putting items away; staff to stand by for safety during showers as allowed by AV; providing AV with a shower bench to sit on while drying off outside the shower; and encouraging AV to use the call light and wait for assistance before standing or transferring. On or about March 22, 2026, facility staff found AV locked inside AV’s bathroom, on the floor, having fallen backward in the shower chair. AV was transported by EMS to the emergency room due to pain and was diagnosed with alcohol intoxication. The Respondent failed to develop and implement suitable interventions. This constitutes abuse by neglect as defined in OAR 411-020-0002(1)(b)(A)(i).
