Findings: The Alleged Victim (AV) relies on the facility to provide care, support and a secure environment. AV and Witness 1 (W1) are often alone in AV;s room and the facility has not provided staff with adequate training to ensure the safety of AV and W1 and determine if AV and W1 have the capacity to consent to a sexual relationship. The facility failed to provide staff with adequate guidance and oversight on monitoring sexual relationships which could lead to a serious risk of harm to AV and W1. This failure is a violation of resident rights, is considered neglect which constitutes abuse.
