Findings: On or about February 1, 2023, the Oregon Health Authority (OHA) reported to the Department that Respondent failed to comply with weekly reporting requirements of vaccinated individuals, residents and staff, to the proper authority as required by law. This failure has been ongoing from October 1, 2022, to December 31, 2022, for a total of 90 days, and additionally from January 1, 2023 to January 31, 2023, for an additional 30 days. The Department sent a letter to you October 2022, a Civil Penalty November 2022, a Civil Penalty December 2022, and a Civil Penalty January 2023, which informed you of the failure to report for previous days, and that if you did not report to OHA by February 1, 2023, you would be receiving an additional penalty in the amount of $7,500.00. The facility has failed to comply with this request for the month of October 2022, the month of November 2022, the month of December 2022, and the month of January 2023 resulting in a Civil Penalty.
