Findings: The facility failed to provide a safe medication administration system to ensure the Alleged Victim's (AV) medication was administered as ordered. The failure resulted in AV experiencing unreasonable discomfort and a potential for serious harm, which is a violation of resident rights, is considered neglect of care and constitutes abuse. For the conduct cited in this notice, DHS would have imposed a separate level 3 civil penalty in the amount of $1,500.00 pursuant to ORS 441.731(3)(a). However, this facility has been assessed more than $20,000 in penalties under ORS 441.731(3)(a)(A) to (D) within the same 90-day period. Therefore, under ORS 441.731(3)(c), DHS is prohibited from imposing further civil penalties in the same 90-day period.
