Findings: On or about August 7, 2021, Alleged Victim (AV) and Witness 1 (W1) had a resident-to-resident altercation in which W1 was observe swinging at AV prompting AV to throw a chair at W1. An investigation determined that W1 has a history of physical aggression towards residents and staff, with six noted aggressive interactions with staff and/or residents from July 12, 2021 through August 7, 2021. The facility's failure to provide a safe environment for AV is a violation of resident rights, is considered neglect of care and constitutes abuse.
