Findings: On or about November 26. 2021, Witness #6 (W6) and the Alleged Victim (AV) were engaged in an altercation. W6 is known to have behaviors and has been in multiple altercations and has been on alert charting for engaging in altercations. On the day of the incident, W6 went into AV's room and used the bathroom, AV asked W6 to leave, W6 picked AV up and threw AV to the floor, causing AV to break his/her hip, requiring surgery. The facility failed to assess and properly care plan for W6's behaviors, placing AV at risk for serious harm. The facility's failure is a violation of resident rights, is considered neglect of care and constitutes abuse.
